President Al-Shara Issues a Decree to Establish the "General Authority for Supply and Supply" to Regulate Government Contracts

 President Ahmed Al-Sharaa issued Decree No. (63) of 2026, which calls for the establishment of a public body called the "General Authority for Supply and Supply" in Syria.

 

The text of the decree is as follows:

Based on the provisions of the Constitutional Declaration.

and the requirements of the supreme national interest.

It draws the following:

 

Chapter One

Definitions

 

Article (1):

The following words and phrases in the application of the provisions of this Decree shall have the meaning set forth next to each of them:

General Secretariat: General Secretariat of the Presidency of the Republic

Secretary-General: Secretary General of the Presidency of the Republic

Authority: General Authority for Supply and Supply

Board: Board of Directors of the Authority

Director General: Director General of the Authority

Public Entity: It is one of the ministries, public administrations, public bodies, local administrative units, municipalities, endowment departments, or public institutions, companies, and establishments.

 

Chapter Two

Events, Objectives & Tasks

 

Article (2):

In the Syrian Arab Republic, there shall be a public body called the "General Authority for Supply and Supply", which enjoys legal personality and financial and administrative independence, and is linked to the General Secretariat of the Presidency of the Republic, and is based in the city of Damascus.

 

Article (3):

The establishment of the Authority aims to organize and unify contracting procedures in order to provide the needs of public entities with the best technical specifications and the most appropriate prices, in order to achieve transparency and improve the efficiency of government spending.

 

Article (4):

The Authority undertakes the following tasks:

a. Receiving requests from public entities regarding the required needs accompanied by a statement from the Department's accountant of the availability of the necessary financial appropriation in internal contracts with an estimated value exceeding (5,000,000) Syrian Pounds five million Syrian Pounds or its equivalent in U.S. dollars, and foreign contracts whose estimated value exceeds (10,000,000) Syrian Pounds Ten Million Syrian Pounds or its equivalent in U.S. dollars in accordance with the provisions of this Decree, and these values may be amended by a decision of the Secretary-General upon the proposal of the Council.

b. Preparing the legal, financial and technical condition books in coordination with the public entity requesting the need.

c. Announcement of the tender or request for proposals, as the case may be.

d. Settle the submitted bids and refer the bid to the most suitable bidder.

e. Organize and sign the contract with the nominated contractor, and complete the procedures for its ratification in accordance with the laws and regulations in force.

F. Refer the contract to the public entity requesting the need to follow up on its implementation procedures, pay the contracting contractor's dues, and liquidate the contract.

 

Chapter Three

Authority Management and Tasks

 

Article (5):

The Authority is responsible for managing the

a. Board of Directors.

B. General Manager.

 

Article (6):

The Board of Directors shall meet whenever necessary at the invitation of the Chairman of the Board, and the meetings shall be legal in the presence of the majority of the members, including the Chairman of the Board, and decisions shall be taken by unanimous vote or by a majority of the votes of the members present, and in the event of equal votes, the Chairman of the Board shall prevail.

The Chairman of the Board of Directors shall have the right to invite whomever he deems appropriate to attend the meetings of the Board of Directors without having the right to vote.

The members of the Board of Directors shall receive compensation for attending each of the Board meetings.

 

Article (7):

The Board of Directors shall be named by decree upon the proposal of the Secretary-General.

The Director-General shall be appointed by decree upon the proposal of the Secretary-General.

 

Article (8):

The Board of Directors shall undertake the following tasks:

Formulate the general policy of the Authority and develop plans that achieve its objectives, and is responsible for approving and implementing them within the provisions of the laws and regulations in force.

B. Supervise and control the contracting procedures starting from the announcement of the need and ending with the referral to the most suitable bidder and signing the contract with him.

c. Ratification of the draft contracts submitted to him.

 

Article (9):

The Director General shall undertake the executive management of the Authority, including all the necessary procedures for the contracting process until the organization and signing of the contract.

The Director General shall represent the Authority before the judiciary and third parties.

The Director General shall be the Maintenance Officer and the Liquidation Officer.

 

Chapter Four

General and Final Provisions

 

Article (10):

It shall be in the general budget of the State (section and branch) under the name of the "General Authority for Supply and Supply".

 

Article (11):

The functional structure, including the numerical staff, shall be issued by decree.

 

Article (12):

The executive instructions for the provisions of this Decree shall be issued by a decision of the Secretary-General.

 

Article (13):

The Authority's administration is tasked with preparing the necessary draft legislative instrument.

 

Article (14):

This decree shall be published in the Official Gazette.
